US-UAE FTA - Emergency Committee For American Trade: "As discussed above with respect to investment, UAE maintains non-tariff barriers through agency-sponsor-distributors requirements that reduce opportunities not only for investment, but for the distribution and sale of U.S. agricultural and manufactured exports. In particular, the UAE Commercial Agencies law requires that agents must be UAE nationals or companies incorporated in the UAE and entirely owned by UAE nationals; these agents are also given rights that severely impede the ability of foreign-based companies to distribute and service their products (i.e., agents have the ability to stop arbitrarily imports, and it is difficult to terminate non-performing agents). Such restrictions should be eliminated during the course of the FTA negotiations and, to the extent applicable, U.S. negotiators should seek to fix agency issues in a manner similar to that accomplished in the US.-Central America-Dominican Republic FTA." (Seems to be dated 2002, but argument and perspective is still useful to have.)
